Rita Dey Chowdhury (2017) — around a quarter of net salary for a spouse — widened into a range. Your matter turns on facts it does not ask about: liabilities actually being serviced, the standard of living during the marriage, a career given up, health, and what both of you put in your affidavits of disclosure.

Is there a formula for maintenance in India?

No. No statute sets a percentage. The Supreme Court in Kalyan Dey Chowdhury v. Rita Dey Chowdhury (2017) treated around a quarter of net salary as just and proper for a spouse, and that benchmark is what practice has grown around — but every award turns on the facts of the case.

Does the wife's own income reduce maintenance?

It is one of the factors. A claimant with an income of their own needs less, but courts also weigh earning capacity, a career given up during the marriage, and who the children live with.

From when is maintenance payable?

Ordinarily from the date of the application, not the date of the order. Where a matter runs for two years, the arrears can be larger than the monthly figure.

Is maintenance for children counted separately?

Yes. A child's right to be maintained is the child's own, and education costs are usually dealt with separately from monthly maintenance.
